This Policy applies to information collected on the Site and any webpage, application, or other online offering that links to it (collectively, the “Services”).

Information We Collect

Information You Give Us Directly

When you contact us by phone, web form, email, or text, you may provide personal information such as your name, phone number, email address, and mailing or location information, along with details about your situation — for example, the flight, aircraft, or fume event involved, your role (pilot, cabin crew, passenger, or ground crew), your reported symptoms, and any documents you choose to send us. If we agree to represent you, we may also collect additional information necessary to handle your matter, including, where applicable, a Social Security number or financial account information for the distribution of settlement or other payments. You decide what to share; some information may be required to respond to your request. Please do not send confidential or sensitive details until we have agreed in writing to represent you (see our Terms of Use).

Information Collected Automatically

When you visit the Site, we and our third-party providers may automatically collect device and usage data such as your IP address, general location, browser type, operating system, the pages you view, links you click, referring website or ad, and the date and time of your visit. We collect this information using cookies, log files, tracking pixels, and similar technologies.

Call Tracking

We use call-tracking technology. When you call a phone number shown on this Site, your call may be routed through a tracking service and may be recorded or monitored for quality, training, case-intake, and marketing-measurement purposes. Call-tracking services may capture your phone number, the date and time of the call, its duration, and the marketing source associated with the number you dialed. By calling us, you consent to this where permitted by law. Some states require all-party consent to record calls; we and our providers aim to comply with applicable recording-consent laws.

How We Share Your Information

We do not sell your personal information for money. We may share information in these limited ways:

  • Service providers / processors: vendors who host the Site, manage web forms, provide call tracking and recording, send communications, and provide analytics and advertising measurement. They may use your data only to perform services for us.
  • Co-counsel or referral counsel: if your matter requires an attorney licensed in another state, or when we jointly represent or refer a matter, we may share relevant information with the other lawyers, consistent with our ethical duties and with precautions to preserve confidentiality and any applicable privilege.
  • Legal and safety reasons: when required by law, subpoena, or court order, or to protect our rights and property, our clients, or the safety of others.
  • Business transfers: in connection with a merger, reorganization, financing, or sale of assets, subject to this Policy.
  • De-identified or aggregate data: we may share information that no longer identifies you for internal analysis or marketing.

Note that some sharing for cross-context behavioral advertising may be considered a “sale” or “sharing” under certain state privacy laws even when no money changes hands; see “Your Privacy Rights” below.

Text Messaging

If you provide your mobile number, you consent to receive calls and text messages from us about your inquiry, including by automated means where permitted. Message frequency varies. Message and data rates may apply. You can opt out of texts at any time by replying STOP, or reply HELP for help. Opting out of marketing texts will not stop transactional messages necessary to handle a matter you have asked us about. Mobile opt-in data is not shared with third parties for their own marketing.

Data Retention

We keep personal information for as long as needed to respond to your inquiry, evaluate or handle your matter, comply with our legal, ethical, and record-keeping obligations, resolve disputes, and enforce our agreements. Retention periods for client and prospective-client records may be governed by applicable bar rules and law. When information is no longer needed, we take reasonable steps to delete or de-identify it.

Information Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no website or transmission over the internet is completely secure, and we cannot guarantee absolute security. We are not responsible for the security of information you transmit to us over networks we do not control. Please avoid sending highly sensitive information through web forms or unencrypted email.

Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information under applicable state privacy laws. Subject to certain exceptions, these may include the right to:

Where required by law, we will honor applicable opt-out preference signals. California’s “Shine the Light” law (Civil Code § 1798.83) also permits California residents to request information about disclosures of personal information to third parties for their direct marketing purposes; you may make such a request using the same contact details.

Categories of Personal Information We Collect

In the preceding 12 months, we may have collected the following categories of personal information, as defined by California and other state privacy laws: identifiers (such as name, postal address, email address, IP address, and online identifiers); telephone number and other records described in Cal. Civ. Code § 1798.80; protected classifications under state or federal law; commercial information; internet or other electronic network activity; geolocation data; audio information (such as call recordings); professional or employment-related information; and inferences drawn from the above. We collect this information from you, automatically through your use of the Site, and from service providers, and we may disclose it to service providers, co-counsel or referral counsel, and others as described in “How We Share Your Information.” We have not sold personal information about consumers for money in the preceding 12 months.

Children’s Privacy

This Site is intended for adults. We do not knowingly collect personal information from children under 13 (or the minimum age set by applicable law). If you believe a child has provided us information without parental or guardian consent, please contact us so we can take appropriate steps. Information about an injured minor may, of course, be provided by a parent or guardian seeking help with a claim.
